General
Insurance Questions
Q: What is
"Liability Insurance?"
A: Liability Insurance protects you against certain kinds of
Lawsuits. For example, if a spectator or player is injured because
of your negligence, liability insurance would pay for your legal
fees and any court judgments that resulted from the suit.
Q: What is "Excess
Accident Insurance?"
A: Excess Accident Insurance provides accidental medical coverage to
injured players over and above any other health insurance or any
other health plan carried by that player. Thus, once the primary
insurance has paid out its full benefits, the Team Accident
Insurance Plan will be used to cover the unpaid medical bills,
including the deductible and any co-insurance amounts, up to the
policy limits. If the injured player has no other coverage, then the
Team Insurance plan will pay benefits on a primary basis.
Q: Why does my team
need both Liability and Accident Insurance?
A: Because you will then cover the two major exposures that threaten
softball teams and leagues: 1) Lawsuits from injured spectators and
players; and 2) Medical Expenses that result from injuries to
players on your team.
Q: What proof of
coverage will I receive when I buy Team Insurance?
A: You will receive a certificate of insurance for your team or
league, which will be sent to you promptly after Bollinger receives
your completed enrollment form and check.
Q: Can I buy ASA
Insurance by credit card?
A: Yes, the acceptable credit cards are Visa and MasterCard.
You can
pay by credit card online, or call Bollinger.
Q: When is my
insurance effective?
A: Coverage goes into effect the day after the postmark on your
enrollment form and valid check. All liability and accident
coverages expire on December 31st.
Eligibility Questions
Q: Who can purchase
Team Insurance?
A: Only Teams and Leagues that are currently registered with ASA for
the current year are eligible to buy the ASA Team Insurance Plan.
Q: How do I register
my Team/League with ASA?
A: Contact your local ASA Commissioner to register. You can get your
local commissioner’s name and phone number from the ASA National
Office (1-405-424-5266) or from Bollinger (1-800-526-1379) or visit
the ASA's website at
www.asasoftball.com.
Q: How many teams
are needed to qualify for the reduced League Rates?
A: To qualify for the League Rates, ALL TEAMS in your league
must purchase insurance (with a minimum of four teams). And you must
apply using one enrollment form.
Coverage
Questions
Q: Can Adult Leagues
further reduce their Accident and Liability costs by using Waiver &
Release Roster forms?
A: Yes. If Adult Leagues obtain signed Waiver & Release forms from
all of their players, they are eligible for even LOWER accident
liability rates. Contact Bollinger for rates and sample Waiver &
Release forms. (Leagues Only)
Q: Can only one
individual team in a league buy insurance?
A: Yes. However, individual teams must pay a higher rate than teams
in a fully insured league. Individual Teams are not eligible for the
League Rates, but must use the "Single Team" Rate.
Q: Does Liability
Insurance cover the players and coaches on our team?
A: Yes. If an individual team member or coach is sued because of
bodily injury or property damage to others arising out of your team
or league’s activities, he or she will be covered by the Team
Liability Insurance Plan. However, liability insurance is not
intended to cover medical expenses from injuries to your team
members. Your team must buy Accident Insurance to cover those type
of expenses.
Q: Will Liability
Insurance cover team members preparing the field before a game?
A: Yes. If a participant is injured while preparing the field, such
as lining or raking, and the injury is caused by the negligence of
the team or league, then coverage applies; but only if the field
preparation is incidental, such as lining or raking , and only if it
is done immediately before a game.
Q: Does the
Liability Insurance cover Teams or Leagues for the Tournaments they
run?
A: Yes. Liability Insurance covers all softball activities of the
Team or League, including tournaments. But your team’s insurance
does not cover other teams. Only your team or league is covered
for the tournament under your insurance. If you sponsor an ASA
tournament and want to make sure that all teams are covered, please
see the "ASA
Tournament Insurance Plan for Tournaments and Clinics" section
for further details or call Bollinger.
Q: Are fund raisers
covered by the Team Liability Insurance?
A: Yes. Fund raising activities, award dinners and team meetings are
covered. Fund raisers must be usual, non-hazardous and incidental,
such as bake sales, raffles and car washes. Activities such as
carnivals, fireworks or bungee jumping would not be covered. There
is no liability coverage for the serving or selling of alcoholic
beverages.
Q: Are opposing
teams covered under our Team Insurance?
A: No. Your Team is covered if the opposing team sues you or your
team or league for injury to one of their players. But the opposing
team or their activities are not covered by your Team Insurance.
Q: Will liability
insurance cover concession stands?
A: Yes. The policy covers liability arising out of the operation of
concession stands if the concession stand is operated by the
insured. Note: There is no coverage for the sale, distribution or
consumption of alcoholic beverages or for Worker’s Compensation
claims.
Q: Can I add an
"Additional Insured" to my liability insurance coverage?
A: Yes. If a field owner or municipality requires that you add them
as an additional insured, you may do so at no additional charge.
Q: Are All Star
Teams covered by the Team or League Insurance Plan?
A: No. All Star Teams are not covered under individual team
policies. All Star Teams may be covered under league policies if the
All Star players all come from the insured league and play a limited
schedule. However, if the All Star Team registers separately with
ASA, then that team must purchase a separate policy.
Other
Questions
Q: What if I'm in a
hurry and need a certificate today?
A: For immediate service, you can purchase the ASA Team insurance
on-line, where you will be able to print your own certificate(s)
upon acceptance of your credit card transaction. Or, Bollinger can
process your rush order for a charge of $25 per certificate
Q: Do all teams have
to send a team roster when they purchase team insurance?
A: No. Only adult teams that buy the Waiver & Release plan for a
lower premium are required to complete the Waiver & Release Roster
Forms and maintain these forms on file. Copies of these forms must
be sent to Bollinger in the event of a claim.
Q: Are any other
insurance coverages available to ASA Leagues?
A: Yes. See our "Optional Insurance Plans for ASA Leagues" brochure
for Directors & Officers Liability, Crime Insurance and Equipment
coverage for your league.
Questions on the Field Owners Liability Insurance
Q: Who is covered
under the Field Owners Liability Insurance Program?
A: Only the Field Owner (or long term lessee) is protected from
lawsuits (alleging bodily injury, property damage or personal
injury) that arise out of the play of ASA Softball by ASA registered
teams on his/her fields. Teams and leagues may not purchase the
field owners coverage.
Q: What Options are
available to Field Owners?
A: The Field Owner has two options when purchasing the $2,000,000
Liability Plan. Plan A costs $200 and the Field Owner must obtain
signed Waiver & Release forms from all players using the fields.
Under Plan B, there is no Waiver & Release requirement, and the
premium is $1,000.
Q: Are those the
only Liability Insurance options for a Field Owner?
A: No. The Field Owner can also obtain liability coverage at NO COST
to the Field Owner. The Field Owner simply needs to require that all
teams using the fields purchase ASA Team Liability Insurance and add
the Field Owner as an Additional Insured onto that policy. In
addition, there is no Waiver & Release requirement under this
option.
Q: Under Plan A, who
should obtain and keep the signed Waiver & Release forms?
A: The Field Owner is responsible for this, since he/she is the one
who is indemnified by the Waiver forms, and because he/she is the
one protected by the liability policy. We recommend the Waiver &
Release forms be kept on file for at least 3 years.
Q: Does a Field
Owner have to use the Waiver & Release forms supplied by Bollinger?
A: No. A Field Owner can use his/her own forms IF
they meet the specifications outlined by Bollinger, which are sent
to the Field Owner with the Certificate of Insurance.
Q: Will coverage be
provided for a lawsuit from a pick-up player who has not signed a
Waiver form?
A: Yes. If the Field Owner has made a diligent effort to obtain
signed releases on a regular systematic basis from all ASA players,
there would be coverage for such an exception.
Q: Do spectators and
bystanders have to sign Waiver & Release forms?
A: No. There is no requirement under any of the Plan Options that
spectators need to sign Waiver & Release forms. The Field Owner is
fully protected from lawsuits from spectators or bystanders that
arise out of the play of ASA Softball on the covered fields.
Q: Are Field
Inspections required?
A: Yes. All field owners insured under this plan must conduct field
inspections on all fields and surrounding premises to ensure that
they are safe, playable and hazard free. Inspection Forms will be
provided to all Field Owners by Bollinger.
Q: Does the
Field Owner Plan cover lawsuits arising out of injuries on
playgrounds or nearby streets?
A: No. Coverage is restricted to claims arising out of injuries that
result from the play or practice of ASA Softball on the Field
Owner’s fields. Thus, injuries occurring on adjoining playgrounds,
nearby streets or parking lots are not covered unless they are the
direct result of the play of ASA Softball.
Q: Does Bollinger
provide any Risk Management Tools that will help Field Owners better
manage their operations?
A: Yes. Bollinger provides the following Risk Management Tools for
Field Owners:
-
General Safety &
Maintenance Guidelines for your fields
-
Pre-Game Safety
Check List
-

Release Forms
