Linked below are sample Waiver & Release forms. In order for liability coverage to be in full force and effect, all players on ASA registered teams using your field (s) must sign this form. You should select the waiver form that is best suited for your circumstance. Please feel free to reproduce additional quantities of the forms according to your needs.
You can use your own Waiver & Release form, however, the Waiver & Release form should contain the following components to have the best chance of being upheld in a Court of Law.
The form must boldly and clearly state that it is a Waiver and Release of Liability.
The wording on the release should directly follow the heading listed above.
The form should include strong wording as contained in Markel Insurance Companys suggested Waiver and Release form.
Since the waiver and release is a contract, there must be consideration such as "In consideration for the right to play softball . . . . ".
The signatures should directly follow the wording on the release.
The ASA, its Agents and Umpires should be indemnified (named along with the field owner) in the release.
All of the above should be on one side of a page.
We recommend you keep the signed Waiver & Release forms for a minimum of three years (for adults) or until youth Players have reached the age of majority (18).
